Possession of marijuana less than 20 grams is a 1st degree misdemeanor punishable by a maximum of one year in the county jail. 

However, in addition to any sentence imposed by the court for possession of marijuana, if a person is convicted of this crime, then that person’s driver’s license will be suspended for two years.  Therefore, it is important that individual’s charged with this offense be cognizant opt for a pre-trial intervention program or any other method of avoiding a conviction.

If a person possesses more than 20 grams of marijuana, then the charge is upgraded to a 3rd degree felony punishable by 5 years in prison.

Possession of cocaine, heroin, ecstasy/mdma, or a schedule II substance is a 3rd degree felony punishable by 5 years in prison.

Once again, a conviction for this offense requires that one’s driver’s license be suspended for two years.
