with 11 Prior Felony Convictions Found Not Guilty of Robbery
Facing a mandatory life sentence under the prison release re-offender act, Richard Tendler was able to win an acquittal. The defendant was charged with robbery with a deadly weapon. The defendant was accused of beating and taking $20.00 from an elderly man. Evidence against the defendant included the police immediately being called to the scene after the alleged robbery. When the police detained and searched the defendant, the police retrieved exactly $20.00 from the defendant’s possession. The defendant had no other belongings on him other than a $20.00 bill. Nevertheless, the defendant testified that the alleged victim had asked him to lend him some money and that the defendant did not want to lend him money because he only had a $20.00 bill. The defendant held up to rigorous cross-examination by a 15 year veteran prosecutor. The jury heard testimony that the defendant had 11 prior felony convictions.
Robbery Suspect Leaves Wallet at Crime Scene Found Not Guilty
A cashier at a Lake Park 7-11 immediately hit the emergency alarm reporting being robbed at gun point. As the robber reached for the cash register, the robber is seen on video tape dropping his wallet containing his Florida Identification Card. The robber retrieves the money from the cash register and exits the 7-11. Within two minutes, the police arrive and both the police and the cashier identify the wallet left at the scene. The cashier looks at the picture on the Florida Identification Card and definitively states, “that’s the guy.” Based on the information on the Florida Identification Card, the defendant was arrested and charged with robbery with a firearm. At trial, Richard Tendler was able to convince a jury that the defendant was home with his mother and sister at the time of the robbery. Both the defendant’s mother and sister testified that he was home. If convicted, the defendant would have received a mandatory life sentence.
Grandfather Accused of Having Sex with 15-Year Old Granddaughter Acquitted
The defendant’s granddaughter, daughter, and son-in-law all testified that for two years the defendant repeatedly had sex with his granddaughter and had asked others to engage in the same behavior. Richard Tendler along with co-counsel Adrienne Ellis, showed the jury that the defendant’s family had conspired to throw the defendant out of their home. For this reason, Tendler and Ellis argued that the charges were false. After a 3 day trial and only 45 minutes of deliberations, the jury found the defendant not guilty of all 5 counts of sexual activity with a child.
Defendant Charged with Kidnapping, Robbery and Rape Acquitted of All Charges
The alleged victim in the case testified that she met the defendant at a bar. When she exited the bar, she claimed that the defendant forced her into her own car and ordered her to drive to a deserted area. There, she testified that the defendant raped her and then stole her jewelry. When the defendant was apprehended by the police, he was seen selling the jewelry at the local flea market where he was employed. Despite this evidence, Richard Tendler was successful in arguing to the jury that the defendant had engaged in sex with the alleged victim but that it was consensual. The trial lasted one week and the jury acquitted the defendant of all counts. After the verdict, members of the jury congratulated Tendler.
